General Terms and Conditions 

All inquiries and bookings are subject to the above ski school and are subject to the terms and conditions below.

Only the written order confirmations are final for the acceptance of the reservation and the scope of the service.

Oral or telephone agreements only apply if Toby Fishel has expressly confirmed them in writing.

Start times are always agreed with Toby Fishel. Any payments are to be made directly to Toby Fishel.

Limitation of Liability

Develop your skiing, Toby Fishel – is not liable for damage, as long as the damage is not the result of wilful or grossly negligent behaviour on their behalf. Develop your skiing, Toby Fishel recommends that all customers take out Accident and public liability insurance as this is the responsibility of the individual participants. Develop your skiing, Toby Fishel will make every effort to provide support, supervision and ski lessons to the best of his ability and knowledge.

Right of Withdrawal

The customer can withdraw from a contract that has already been paid for, under the following conditions: In the event of injury or illness, if he or she presents a corresponding medical certificate from a doctor, showing he or she can no longer take part in an already booked ski school lessons. The following conditions apply to all other cancellations: No cancellation fee up to 14 days before the start of the service or booking. If you cancel between 14 and up to 8 days there will be a 50% cancellation fee of the basic amount. Cancellations within 7 days before the booking commences will incur a 100% cancellation fee of the basic amount. Covid full reimbursement of any fee already paid – proof from a doctor, medical certificate needed.

Operational Interruptions

If all mountain railways and ski lifts in the entire ski area are not in operation, or the occurrence of an event of force majeure means that the ski school lessons cannot take place, the customer is entitled to a refund of any fee already paid.

If a service that has already been booked is cancelled for other reasons that are attributable to Toby Fishel (e.g. due to illness), Toby Fishel has the right to change the allocation at its own discretion.

If a ski lesson or the requested service is terminated prematurely due to the customer’s lack of fitness or inappropriate sports equipment, all customer claims for reimbursement shall be void.
